SMS Terms of use

By opting in to or using the Fidus text message service (“Text Message Service”), you accept these Terms & Conditions. This agreement is between you and Fidus (“Fidus,” “we,” “our,” or “us”).
Definitions
“Opting In,” “Opt In,” or “Opt-In” means requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.
“Text Message Service” means any arrangement in which we send one or more messages to your mobile phone number, including SMS, MMS, or successor protocols/technologies.
Consent to Text Messaging
By consenting to receive text messages from us, you agree to these Terms & Conditions, our general Terms of Use (https://fidus.com/terms), and our Privacy Policy (https://fidus.com/privacy), which are incorporated by reference.
E-Sign Disclosure
By agreeing to receive text messages, you consent to use of an electronic record to document your agreement. You may withdraw your consent to use of the electronic record by replying STOP to any message.
Privacy for the Text Message Service
We respect your privacy. We use information you provide through this service only to transmit mobile messages and respond to you. This includes sharing information with platform providers, phone companies, and other vendors who assist with delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties. We may disclose information as necessary to satisfy law, regulation, or governmental request; to avoid liability; or to protect our rights or property. This Text Message Service privacy section applies to your use of the Text Message Service and does not modify our general Privacy Policy referenced above.
Costs
Fidus does not charge you for messages you send or receive via this service; however, message and data rates may apply depending on your mobile plan and provider.
Message Frequency
This service supports conversational person-to-person communication between you and Fidus employees (e.g., project managers). We may send an initial message describing the service. After that, the number of messages you receive will vary based on project activity and your interactions (for example, when you send a HELP request).
Opting Out
You may opt out at any time by replying to any message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE. Because this is a person-to-person service, opt-out requests apply to each conversation/phone number pairing. After unsubscribing, we may send a confirmation message.
Supported Keywords
HELP: We will respond with contact information or assistance details.
STOP/QUIT/END/REVOKE/OPT OUT/CANCEL/UNSUBSCRIBE: We will stop sending messages to that conversation/number and confirm your opt-out.
Carrier Disclosures
Delivery of messages is subject to effective transmission by your wireless provider. Carriers are not liable for delayed or undelivered messages. Availability may vary by carrier and device.
Eligibility & Use
You must be the account holder or have the account holder’s permission for the mobile number you provide. You agree not to use the service for unlawful or abusive purposes and to provide accurate, current information.
Changes to These Terms
We may modify these Terms or the Text Message Service at any time. Updates will be posted at https://fidus.com/SMSterms and will apply when posted. Your continued use after changes are posted constitutes acceptance.
